DEFINITIONS AND RULES OF CONSTRUCTION
Section 1400 - Definitions
Section 1400:00. Persons, Defined. The word "persons," unless otherwise specified, when used in this codification of ordinances, shall mean and include a natural person of either sex, persons, copartnerships, corporations, associations of persons, and any organization or other group acting as a unit and shall include the manager or agent of the aforesaid. It shall also include any executor, administrator, trustee, receiver or other representative appointed by law. Whenever the word "person" is used in any section prescribing a penalty or fine, it shall include the partners or members of any partnership or corporation, and, as to corporation, the officers, agents or members thereof who are responsible for the violation. The singular shall include the plural and all pronouns shall include the masculine, feminine and neuter.
Section 1400:05. City and Municipality, Defined. The word "City" and the word "Municipality," unless otherwise specified herein, shall mean Owatonna, a municipal corporation, duly incorporated and located in Steele County, Minnesota.
Section 1400:10. This Ordinance, Defined. The term "This Ordinance" used in this Code shall refer to the chapter or section in which it appears and related sections, subsections and subdivisions under the same chapter or section.
Section 1400:15. Penal Offense, Defined. The term "Penal Offense" shall mean the violation of an ordinance, code or other legislative action of the Council for which fines or imprisonment are prescribed and shall have the meanings set forth in Sections 1100:00, 1100:05 and 1100:10 of this Code. Penal offenses, even though the word "misdemeanor" is erroneously used, shall be distinguished from violations of State law called misdemeanors which are defined in State law.
Section 1400:20. Petty Offense, Defined. The term "Petty Offense" shall mean the violation of an ordinance, code or other legislative action of the Council for which a sentence of a fine of not more than two hundred dollars ($200) may be imposed and no sentence of imprisonment may be imposed and shall have the meanings set forth in Sections 1100:00, 1100:05 and 1100:10 of this Code. Petty offenses, even though the word "misdemeanor" or term "petty misdemeanor" may be erroneously used, shall be distinguished from violations of State law called misdemeanors which are defined in State law, and further distinguished from violations of State law called petty misdemeanors which are described in State law.
Section 1400:25. Et Seq., Defined. The term "et seq." following a section or subsection shall mean the sections or subsections designated, together with such sections or subsections following thereafter as shall pertain to the same subject matter, or otherwise shall be so related that they shall be considered together for a proper expression of intent or purpose.
Section 1400:30. Minor, Defined. The term "minor" shall mean an individual under the age of eighteen (18) years. The term "minor," as used in Chapter VIII, shall include any person who has not attained the age of twenty-one (21) years.
