Section 494 - Trees, Shrubs and Vines - Removal Treatment and Care
Section 494:00. License Required. It shall be unlawful for any person to cut, trim, prune, remove, spray or otherwise treat trees, shrubs or vines which are located on or extend over any public street, boulevard, park or other public place, for another, without a license therefor.
Section 494:05. Application. Application for a license shall be made at the office of the Clerk-Treasurer upon the form provided as hereinafter set forth.
Section 494:10. Insurance Required. No license shall be issued, nor shall the same be effective until the applicant shall file with the Clerk-Treasurer a certificate of public liability insurance policy, approved by the Attorney, covering all operations of such applicant, in the amount of at least $300,000 combined single limit in case of injury to persons and damage to property in any one (1) accident. Such policy shall be written so as not to allow any sum for any portion of liability for damages to property to be deductible. The City of Owatonna shall be named, and the insurance provided shall include the City as an additional party insured. Should any such insurance policy be cancelled, the City shall be notified and the license issued hereunder shall be suspended and inoperative until satisfactory insurance is provided. No license shall be required when the work to be done is performed under the direction of the Public Utilities Commission, a City Department Head or other public utility otherwise authorized to use the streets of this municipality for work related to such utilities.
Section 494:15. License Fee. The annual license fee shall be in the amount duly established by the Council from time to time, which license shall expire March 31st of each year.
Section 494:20. Application Form. The application for a license shall be made on a form approved by the Council, which shall show, among other things, the name and address of the applicant, the number and names of the employees of applicant, the number of vehicles of applicant, together with a description and license number of each, and the type of equipment proposed to be used.
