Section 676 - Parking Assessment District

Section 676:00. Parking Assessment District Established. The City Council, pursuant to authority granted in Minnesota Statutes, Section 459.14, hereby establishes a Parking Assessment District within the boundaries of the following described tract for the purpose of acquisition, development, maintenance and repair of additional parking facilities, and spreading an equitable part of the costs through special assessments against benefited properties:

Beginning at the intersection of the north right-of-way line of Rose Street, and the westerly right-of-way line of Hoffman Drive;

Thence east along said north right-of-way line of Rose Street to its intersection with the center line of the Straight River;

Thence north along the center line of the Straight River to a point due west of a point thirty six and three-tenths (36.3) feet north of the intersection of the north right-of-way line of Rose Street and the west right-of-way line of North Oak Avenue;

Thence east to a point on the east right-of-way of North Oak Avenue thirty-six and three-tenths (36.3) feet north of the intersection of the north right-of-way line of Rose Street and the east right-of-way line of North Oak Avenue;

Thence north along said east right-of-way line of North Oak Avenue to its intersection with the northwest corner of Lot 2, Block 4, Abbott's Addition;

Thence east along the north line of said Lot 2, Block 4, Abbott's Addition, to its intersection with the west line of Lot 1, Block 1, Howe's Addition.

Thence north along said west line of Lot 1, Block 1, Howe's Addition, ninety-nine (99) feet;

Thence east six and eight-tenths (6.8) feet; thence north ten (10) feet, continuing north along the west line of Lot 2, Block 1, Howe's Addition, to its intersection with the south right-of-way line of Fremont Street;

Thence east along said south right-of-way line to its intersection with the east right-of-way line of North Cedar Avenue;

Thence north along the east right-of-way line of North Cedar Avenue to a point eighty-two and five-tenths (82.5) feet north of the north right-of-way line of Fremont Street;

Thence east one hundred eighty-five (185) feet; thence south to the intersection with the south right-of-way line of Fremont Street;

Thence east along said south right-of-way line to its intersection with the northeast corner of Lot 19, Block 1, Pettit's Addition;

Thence south along the east line of said Lot 19, Block 1, Pettit's Addition, to the northeast corner of Lot 6, Block 1, Pettit's Addition;

Thence east along the north line of Lots 7, 8, 9 and 10, Block 1, Pettit's Addition, to the northeast corner of Lot 10, Block 1, Pettit's Addition;

Thence south along the east line of said Lot 10, Block 1, Pettit's Addition, sixty-two and thirty-seven one-hundredths (62.37) feet; thence east one hundred sixty-five (165) feet to the east right-of-way line of North Elm Avenue;

Thence south along said east right-of-way line of North Elm Avenue to its intersection with the south right-of-way line of North Elm Avenue;

Thence south along said east right-of-way line of North Elm Avenue to its intersection with the south right-of-way line of Rose Street;

Thence east along said south right-of-way line of Rose Street, one hundred fifteen and five-tenths (115.5) feet; thence south one hundred five and ninety-three one-hundredths (105.93) feet; thence east forty-nine and five-tenths (49.5) feet; thence south one hundred twenty-two and forty-two one-hundredths (122.42) feet to the north line of Lot 3, Block 21, Original Town;

Thence east along the north line of Lots 3 and 4, Block 21, Original Town, to the northeast corner of Lot 4, Block 21, Original Town;

Thence south along the east line of Lot 4, Block 21, Original Town, to the north right-of-way line of Pearl Street;

Thence west along said north right-of-way line of Pearl Street one hundred sixty-five (165) feet; thence south two hundred fourteen and five-tenths (214.5) feet to the north line of Lot 2, Block 11, Original Town;

Thence east along said north line of Lot 2, Block 11, Original Town, to the northeast corner of Lot 2, Block 11, Original Town;

Thence south sixty-six (66) feet; thence west sixty-two (62) feet; thence south one hundred thirty-two (132) feet to the south right-of-way line of Vine Street; thence west along said south right-of-way line of Vine Street to the northeast corner of Lot 18, Block 12, Original Town, thence south eighty-four (84) feet; thence east eighteen (18) feet, thence south to the north line of Lot 2, Block 12, Original Town;

Thence east along the north line of Lots 2, 3 and 4, Block 12, Original Town, to a point twenty-two (22) feet east of the northwest corner of Lot 4, Block 12, Original Town; thence south to north right-of-way line of Broadway Street;

Thence west along said north right-of-way line of Broadway Street to the east right-of-way line of Elm Avenue;

Thence south along said east right-of-way line of Elm Avenue to its intersection with the south right-of-way line of Main Street;

Thence east along said south right-of-way line of Main Street to the northeast corner of Lot 2, Block 14, Original Town;

Thence south along the east line of Lot 2, Block 14, Original Town, to the southeast corner of Lot 2, Block 14, Original Town; thence west thirty-three (33) feet; thence south to the north right-of-way line of Mill Street;

Thence west along said north right-of-way line of Mill Street to its intersection with the east right-of-way line of Elm Avenue;

Thence north along said east right-of-way line of Elm Avenue to a point sixty-six (66) feet north of the north right-of-way line of Mill Street;

Thence west along a line parallel to and sixty-six (66) feet north of the north right-of-way line of Mill Street to the east line of Lot 12, Block 6, Original Town;

Thence south along the east line of Lot 12, Block 6, Original Town, to the north right-of-way line of Mill Street;

Thence west along said north right-of-way line of Mill Street to its intersection with the east right-of-way line of South Cedar Avenue;

Thence north along said east right-of-way line of South Cedar Avenue to a point one hundred forty-eight and five-tenths (148.5) feet north of the north right-of-way line of Mill Street;

Thence west along the south line of Lots 1 through 16, Block 7, Original Town, extended to its intersection with the west right-of-way line of South Oak Avenue;

Thence north along said west right-of-way line of South Oak Avenue to a point one hundred ten (110) feet south of the northeast corner of Lot 1, Block 8, Original Town;

Thence west along a line parallel and one hundred ten (110) feet south of the south right-of-way line of West Main Street, to a point one hundred eighty-nine (189) feet east of the east right-of-way line of Walnut Avenue;

Thence south along a line parallel and one hundred eighty-nine (189) feet east of the east right-of-way line of Walnut to the south line of Lot 3, Block 8, Original Town;

Thence west along the south line of Lots 3 and 4, Block 8, Original Town, and the south line of Lot 4, Block 2, Cornell, Pettit, Moss, Van Vliet and Durand Addition, extended to the west line of Walnut Avenue;

Thence north along said west line of Walnut Avenue to its intersection with the south right-of-way line of West Bridge Street;

Thence west along said south right-of-way line of West Bridge Street to its intersection with the center line of the Straight River;

Thence northerly along the center line of the Straight River to the southwesterly right-of-way line of Hoffman Drive;

Thence northwesterly along said southwesterly right-of-way line of Hoffman Drive to the point of beginning. All within the City of Owatonna, Township 107 North, Range 20 West.

Section 676:01. Procedures for Making Special Assessments.

Subd. 1. The procedures for financing and assessing benefited property will be those procedures established under Minnesota Statutes, Sections 429.011 through 429.091, not to exclude any other procedures and powers now or hereafter provided by general law or Home Rule Charter; and

Subd. 2. Special assessments will be determined on a project-by-project basis within the Parking Assessment District, pursuant to Minnesota Statutes, Section 459.14, Subd. 7.

Subd. 3. As a condition for the issuance of building permits in the Parking Assessment District, when such permit will involve the construction or remodeling of a structure so that the number of deficient parking spaces as was determined for that property under a specific parking lot assessment increases, the property owner shall pay to the City the difference between the original assessment and the amount that would have been assessed based on the projected parking deficiency. Said money shall accrue in a debt retirement fund for debt incurred in the acquisition and construction of off-street parking within the Parking Assessment District.

Section 676:02. Parking Advisory Committee. There is hereby established an advisory committee to be known as the Parking Advisory Committee of the City of Owatonna.

Section 676:03. Appointment of Members; Terms of Office. Said committee shall consist of five (5) members appointed by the Mayor, subject to approval by the City Council. All members shall be residents of the City and owners of property, tenants, or employees of businesses located within the Parking Assessment District. eff. 12/19/00

All members will serve for three (3) years or until their successor is appointed and qualified. All terms shall begin on May 1 in the year of appointment. Vacancies on the committee shall be filled in the same manner as the initial appointments and shall be for the unexpired term.

Section 676:04. Duties.

Subd. 1. The Parking Advisory Committee shall take under advisement, study and make their written recommendations to the Mayor and Council on matters of public parking. Specific duties shall include recommendations to the City Council on possible parking projects and regulations.

Subd. 2. The Parking Advisory Committee shall assist the City Clerk and City Engineer in the preparation of special assessment rolls for specific projects within the district.

Subd. 3. The Parking Advisory Committee shall establish policies, rules and guidelines necessary to discharge its duties.

Subd. 4. All City departments shall serve as staff and resource to the committee as required and convenient.
