Section 735 - Roller Skating and the Use of Skateboards
Section 735:00. Definitions.
Subd. 1. Unless the context clearly indicates otherwise, the words, combinations of words, terms and phrases, as used in Section 735:00 et seq., shall have the meanings set forth in the subdivisions of this section which follow:
a. "Person" includes an individual, partnership, corporation, the State and its agencies and subdivisions, and any body of persons, whether incorporated or not.
b. "Skateboard" means a device for riding upon, usually while standing, consisting of an oblong piece of wood or of other composition mounted on skate wheels.
c. "Roller skate" means a form of skate with small wheels or rollers instead of a runner.
d. "Operate" means to ride on or upon or control the operation of a skateboard or roller skates.
e. "Operator" means every person who operates or is in actual physical control of a skateboard or roller skates.
Section 735:05. Regulation of the Use of Roller Skates or Skateboards.
Subd. 1. It shall be unlawful for any person to operate a skateboard or roller skates under the circumstances set forth in the subdivisions which follow:
a. On private property of another without the express permission to do so by the owner or occupant of said property.
b. In any careless, reckless or negligent manner so as to endanger, or be likely to endanger, the safety of any person or the property of any other person.
c. Upon any public street or upon any public sidewalk within the downtown area designated as an area bounded on the south by Mill Street, on the west by Oak Avenue, on the north by Rose Street, and on the east by Grove Avenue, and including the area of said designated streets and the sidewalks parallel thereto on both sides of the street.
d. The operator of a skateboard or roller skates emerging from an alley, driveway or building upon approaching a sidewalk or the sidewalk area extending across any alleyway shall yield the right-of-way to all pedestrians approaching the sidewalk or sidewalk area and upon entering the roadway shall yield the right-of-way to all vehicles approaching on the roadway.
e. No person operating a skateboard or roller skating shall attach the same or the person of the operator to any vehicle upon a roadway.
Section 735:05, Subd 1. f.
f. Every person operating a skateboard or roller skating upon a roadway shall ride as close as possible to the right hand curb or edge of the roadway.
g. No person shall roller skate or use a skateboard upon a public street, sidewalk or other roadway after sunset and before sunrise.
